Anti-Monopoly Committee of Ukraine (AMCU) has issued permits for assets bunching and further concession to the companies QTerminals and Risoil having won the state-held tender for the assets Olvia Port and Kherson Sea Trade Port public stevedores accordingly.
In late January 2020 AMCU received the request by the Qatari company – port terminal operator – QTerminals to allow its local daughter company getting to concession the assets belonging to the state enterprise (SE) Stevedoring Company Olvia and SE Ukrainian sea ports authority (USPA) in Mykolaiv city and providing fulfilment of economic activities on rendering stevedore services in Olvia Port.
“Taking into account the fact that the concentration does not result in monopolisation nor substantial obstacle to competition at the goods market of Ukraine, AMCU has granted the permit on concentration requested”, reads the Committee’s report.
As the report notes further on, the QTerminals Group does not yet exercise economic activities in Ukraine, hence there are no structural changes in the stevedore services market occurring.
Subsequently, AMCU has granted a similar permit to LLC Risoil-Kherson, the Committee’s Press Office comments:
“In the end of January 2020 a request by LLC Risoil-Kherson was submitted to AMCU on indirect acquisition of control over the assets of SE Kherson sea trade port and SE USPA operated integrate property complex which ensures effecting economic activities concerned with rendering stevedore services in the sea port of Kherson.”
“The aggregate share of concentration participants in the cargo transport processing services market of sea ports in the stevedoring segment comprises about 2%. Considering that the concession will not result in monopolisation or substantial restriction of competition at the goods markets of Ukraine, AMCU has granted permit on the declared concentration”, says AMCU’s conclusion.
The concession agreements with the tender winners are to be signed within half a year.
