MIU to Complete Kherson Port Assets Transfer to Concessionaire by the End of the Year

Ministry of Infrastructure of Ukraine (MIU) plans to complete the process of state enterprise (SE) Kherson Sea Trade Port (KSTP) assets’ transfer to the concessionaire in 2021, as declared by Vice Minister of Infrastructure Yuriy Vaskov.

According to Vice Minister, in spite of the changes in the list of founders of the legal entity-concessionaire, the final signing of the delivery-acceptance acts will take place as planned within December.

“The sea port Kherson concession is a pilot project. Some inadequacy of the legislation in force has manifested during the transitional period. Now for the concession to succeed, problem issues are solved jointly with other authorities through the by-laws approved. Some delays with the land allocation were detected as well, but this is the scope of local municipalities’ power”, Mr Vaskov noted.

According to him, in parallel with the concession process finalisation, MIU prepars proposals to optimise concession legislation. This will allow avoiding similar situations with a protracted process of transferring objects to concessionaires in the future.

“Last week we received a government decision that will solve the problem of re-issuing permits for sand extraction, and this is a key issue for Kherson port. As for the other project – Olvia port concession – the signing of final documents will take place on 1-2 December”, Mr Vaskov noted.

Earlier, the co-investor of the Risoil-Kherson company, which won the tender for the implementation of the state property concession project in the seaport of Kherson, Dzhemal Inaishvili announced his intention to withdraw from the project. According to him, the main reason for this decision was the delay in the port transfer to the concessionaire.

In August, the co-owner of the Risoil group of companies Shota Khadzhishvili left the project.

In May, Oleksandr Golodnitskiy, Acting Head of SE Ukrainian Sea Ports Authority (USPA), announced that the transfer of the integral property complex of SE KSTP to the concessionaire would be completed in June, later this period was postponed until the end of 2021.

In June 2020, MIU and Risoil-Kherson LLC signed a concession agreement for the integral property complex of SE KSTP and the corresponding property of SE USPA in Kherson Port. The agreement provides for a high rate of variable concession payment (7%), the amount of the fixed concession payment will be 12M UAH, investment obligations – almost 300M UAH. In addition to modernising transhipment facilities, the company plans to acquire its own fleet in the near future and turn Kherson into a river hub.

LLC Risoil-Kherson is a consortium of LLC Petro Oil & Chemicals (Georgian Industrial Group) and Risoil S.A. (Switzerland).
